Can Americans and Britons Buy Off-Plan Property in Dubai?

Yes. US and UK citizens can buy freehold property, including off-plan units, in Dubai's designated areas on the same terms as other foreign nationals under Dubai Law No. 7 of 2006, with no UAE residence visa. The purchase can be run remotely, with payments wired to the project's escrow account, but US and UK reporting rules still apply to the rent.

Can Americans and Britons buy off-plan property in Dubai?

Yes. Dubai's ownership rules treat American and British buyers the same as any other foreign national. Article 4 of Dubai Law No. 7 of 2006 on real property registration reserves general ownership for UAE and GCC nationals, then allows non-UAE nationals, with the Ruler's approval and in areas he designates, to hold freehold title with no time limit or a lease of up to 99 years. The designated areas were first listed in Regulation No. 3 of 2006, later amended. Ask for written confirmation that your project sits in one of them.

No UAE residence visa is required. For individual buyers, the Dubai Land Department (DLD) off-plan registration service asks for a copy of the signed sale and purchase agreement (SPA) and, for non-residents, a passport copy. Nothing in these rules depends on whether the passport is American, British or another nationality.

What differs is on your side: getting a power of attorney accepted in Dubai if you need one, moving the money, and reporting to the IRS, FinCEN or HMRC once you own the unit.

How do you buy Dubai property remotely from the USA or UK?

An off-plan purchase can usually be completed without flying to Dubai, because the developer handles registration. The order below follows the DLD's process and Dubai's off-plan laws; your SPA sets the actual dates and amounts.

7. Title deedUnder Article 8 of Law No. 13 of 2008, completed units are registered in the names of buyers who have met their obligationsCheck it with the DLD's title deed verification service

The DLD fee schedule for off-plan registration shows 2% for the buyer and 2% for the seller; see our DLD fees guide and our Oqood guide.

Do you need a power of attorney, and how is it attested?

Only if someone will sign or act for you, typically at handover or title deed stage. Law firm BSA reported in August 2025 that DLD Circular No. 29/R/2025, dated 16 July 2025, accepts a POA made outside the UAE only where it:

  • was issued within two years before it is presented;
  • has been notarised in the country where it was signed, then legalised by a UAE embassy or consulate, then attested by MOFA, the UAE foreign ministry;
  • is the signed original, as scans are refused;
  • has a full legal Arabic translation by a UAE-licensed translator if written in another language; and
  • names the specific act it permits, such as a purchase or a sale, since broad management wording may be rejected.

The UAE is not a party to the Hague Apostille Convention, while the USA and the UK both are, according to the HCCH status table for the Convention (last updated 30 June 2026). An apostille alone therefore does not make a US or UK document usable in Dubai; the UAE legalisation and MOFA attestation steps above still apply. In the UK, the FCDO Legalisation Office certifies documents by attaching an apostille, as gov.uk explains, and the UAE embassy in London may want that done before it legalises. In the USA, ask the UAE embassy in Washington or the UAE consulate covering your state which prior certification it needs. The UAE Ministry of Foreign Affairs says documents issued abroad are attested through UAE missions, and that you should check whether the mission in your country offers the service online.

How do you send money to a Dubai developer from the USA or UK?

By international bank transfer to the account named in your SPA. Under Dubai Law No. 8 of 2007, a developer selling off-plan must open an escrow account for the project with an approved escrow agent, and off-plan buyers' payments are deposited there. Check that every payment request points to that escrow account, and confirm any change of bank details with the developer through a channel you already trust. Our escrow guide explains the protection.

For US buyers the dirham is pegged at AED 3.6725 to USD 1, a rate in place since 1997 according to Gulf News, so dollar amounts are predictable. Sterling floats against the dirham, so UK buyers carry exchange-rate risk on every instalment.

Illustrative example (not a real project). Of the 239 off-plan projects listed on Profound in October 2026, the median payment plan was 20% down, 30% during construction and 50% on handover. Applied to an AED 2,000,000 unit:

What do US owners report to the IRS and FinCEN?

The IRS states that US citizens and resident aliens are taxed on worldwide income, wherever they live, so rent from a Dubai unit belongs on your US return. The IRS topic on rental income says real estate rentals are generally reported on Schedule E (Form 1040).

FBAR (FinCEN Form 114). A US person who owns foreign financial accounts, or can sign on them, must file an FBAR if their combined value went above USD 10,000 at any point in the calendar year. It goes to FinCEN online, through its BSA E-Filing System, not with your tax return, and it is due on 15 April with an automatic extension to 15 October, according to the IRS. A UAE bank account opened to receive rent or pay service charges counts towards that threshold.

Property held directly is not an account. The IRS's side-by-side table of Form 8938 and FBAR rules says foreign real estate you hold directly goes on neither form. If you hold it through a foreign company, that company is not reported on the FBAR, but for Form 8938 the company counts as a specified foreign asset, and its value includes the property.

Form 8938 (FATCA) thresholds, from the same IRS page (last reviewed 19 September 2026), for total specified foreign financial assets:

FilerYear-end value aboveValue at any point in the year above
Unmarried or married filing separately, living in the USAUSD 50,000USD 75,000
Married filing jointly, living in the USAUSD 100,000USD 150,000
Unmarried or married filing separately, living abroadUSD 200,000USD 300,000
Married filing jointly, living abroadUSD 400,000USD 600,000

What do UK residents report to HMRC?

Gov.uk says UK residents are normally taxed on their foreign income, and it names rent from overseas property as one example. Foreign income is usually reported on a Self Assessment tax return. If you are not UK resident, you do not pay UK tax on foreign income.

The rules changed on 6 April 2025. Before then, people whose permanent home (domicile) was abroad might not have paid UK tax on foreign income; since that date, the 4-year foreign income and gains (FIG) regime has taken the place of the remittance basis. According to HMRC guidance, it is open only to people within their first four years of UK tax residence after at least ten consecutive tax years of non-residence, and the qualifying income it lists covers overseas property business profits.

This is general information, not tax advice. Check your position with HMRC guidance or a UK tax adviser before you file.

Is there UAE tax on Dubai rental income?

Not for an individual holding property as a personal investment. The UAE has no personal income tax, according to PwC's UAE tax summary. Cabinet Decision No. 49 of 2023, in force since 1 June 2023, says real estate investment income of a natural person, where the activity is not carried on under a licence and does not need one, is not treated as a business activity for UAE corporate tax, and such a person does not need to register for corporate tax.

That means the tax question for most US and UK owners sits at home, as described above, not in Dubai. The purchase itself carries the DLD registration fee covered in our DLD fees guide, and owners pay service charges set for each building. For yield maths after costs, use our rental yield calculator.

How do you find a consultant who understands US and UK investors?

Start with licensing. The DLD's Dubai REST app has a Licensed Real Estate Brokers service where you can look up a broker, see office details and download the broker card. Ask any adviser for their broker card and their office's RERA number, and check both.

Then test whether they know your side of the deal. A useful consultant will:

  • show you the project's DLD registration and the escrow account details before you pay;
  • walk you through the SPA's payment dates, handover terms and default clauses, and suggest a UAE lawyer where needed;
  • know the POA attestation route from your country and the wording the DLD accepts;
  • work across your time zone and send documents your CPA or UK accountant can use; and
  • never promise returns or advise on US or UK tax.

Our guide on how to judge a Dubai developer covers the project side. Profound's team, a RERA-licensed brokerage (ORN 28087), works with buyers in the USA and UK on remote off-plan purchases, from shortlist to handover.

This is general information, not legal or tax advice; confirm the rules with the DLD, the IRS or HMRC, and your own advisers.

Frequently asked questions

Yes. Dubai Law No. 7 of 2006 lets non-UAE nationals, Americans included, own freehold property in designated areas, and that covers off-plan units. No UAE residence visa is needed; the DLD asks non-resident buyers for a passport copy with the signed SPA. US reporting rules still apply once you own it.

Pick a project in a designated freehold area, check the broker's RERA licence and the escrow account, sign the reservation form and SPA (often electronically) and wire the payments from the UK. The developer registers the sale on Oqood. As a UK resident you will normally report the rent to HMRC through Self Assessment.

The steps match any foreign buyer: reservation, SPA, Oqood registration by the developer, instalments wired to the project escrow account, handover and title deed. The dirham's fixed USD rate keeps payments predictable. Report rent on your US return and keep FBAR and Form 8938 rules in mind for any UAE bank account.

Not if you own it directly. The IRS says foreign real estate held directly is not reportable on the FBAR or Form 8938. A UAE bank account is different: it counts towards the FBAR's USD 10,000 combined threshold. Holding through a foreign company can bring Form 8938 into play.

No. The UAE does not appear in the HCCH status table for the Convention (last updated 30 June 2026), so an apostille alone does not make a US or UK document valid in Dubai. A POA for a Dubai property deal needs notarisation, legalisation by a UAE embassy or consulate, attestation by the UAE foreign ministry and a legal Arabic translation.

If you are UK resident, normally yes: gov.uk lists rental income on overseas property as foreign income that UK residents usually pay tax on. Some new arrivals can use the 4-year FIG regime, which took over from the remittance basis in April 2025. Confirm your position with HMRC guidance or an adviser.

Not for individuals investing personally. The UAE has no personal income tax, and Cabinet Decision No. 49 of 2023 says an individual's real estate investment income that needs no licence is not a business activity for corporate tax. Tax may still be due in your home country.

Usually, yes. Developers commonly e-sign the SPA, register the sale on the DLD's Oqood portal and the DLD emails you an e-certificate. You only need a POA, attested under the DLD's rules, if someone acts for you at handover or title deed stage.
